State Board of Elections Meeting
State Capitol, Pierre
March 20, 2003
The meeting was called to order by chair Chris Nelson at
8:00a.m. on March 20, 2003 with the following members
responding:

Absent: Beth Benning
Kea Warne, Secretary of State's staff; Sherri Sundem Wald,
Attorney General’s Office; Patty Pearson, Kids Voting;
Robert Kean, SD Advocacy Services; Shelly Pfaff, Coalition
of Citizens with Disabilities; Dave Vogel, Director of
DakotaLink - SD's Assistive Technology project; Jeff
Kisecker, Service to the Blind and Visually Impaired; and
Steve Stewart, Division of Rehabilitation Services.
Lisa Lehan was present from Election Systems and Software
seeking certification for the ES&S iVotronic Version 1 -
7.4.5.0 DRE. Ms. Lehan demonstrated the system including the
supervisor terminal, the voting terminal and the
communications/printer unit. Dave Vogel and Jeff Kisecker
operated the audio component of the unit and provided
suggestions on improvement for the vendor. Ms. Lehan
presented a document detailing how the system meets each of
the certification criteria. Each criteria appeared to be met
by the unit with the possible exception of ARSD
5:02:09:02.02(10) which requires the unit to meet the
disability voting requirements of the Help America Vote Act.
It is unclear at this time whether the Act requires DRE
machines to have the capability to accommodate "puff and
sip" technology for disabled access.
Moved by Viken and seconded to certify the ES&S iVotronic
Version 1 - 7.4.5.0 DRE with the provision that if it is
determined by the Election Assistance Commission that "puff
and sip" compatibility is a requirement of HAVA, the
certification of this model would be revoked. Passed.
Moved by Layher and seconded to recommend that the
Secretary of State introduce legislation correcting the
election calendars for combined school and municipal
elections. Passed.
Moved by Klumper and seconded to recommend that the
Secretary of State introduce legislation applying certiorari
provisions to SDCL 12-21 to all elections. Passed.
Moved by Viken and seconded to recommend that the
Secretary of State introduce legislation allowing the Board
to prescribe the election worker's oath in rule and provide
a penalty for violation. Passed.
