Notary Seals and Commission Changes

Review seal requirements and learn how to report a lost seal or update an address, name, or seal during a commission.

Notary seal requirements

A seal may be purchased from an office-supply company, stationery store, or print shop. An embossing seal or rubber stamp is acceptable.

  • The seal must contain the notary's name.
  • It must contain the words “Notary Public” and “South Dakota.”
  • It must have a border surrounding the imprint.
  • A rubber stamp must contain the word “Seal.”
  • The words “My Commission Expires” and the expiration date must remain outside the seal's border.
  • The seal imprint must match the name and signature recorded with the Secretary of State.

Record every seal before using it

The seal imprint on the Application and Oath is the approved imprint. Before using a different or additional seal, file its imprint with the Secretary of State and wait for approval.

Report Immediately

Lost or stolen seal

Report a lost or stolen seal immediately so the Secretary of State can add a notation to the notary's record.

Option 1

Continue the current commission

Have a replacement seal made, then submit its imprint on the Notary Change Form. The new seal may be identical to the original or a different type.

Option 2

Request a new commission

Ask the Secretary of State in writing to cancel the current commission, then complete the full notary application process for a new commission and expiration date.

Address changes

A South Dakota notary commission is valid in every South Dakota county regardless of the county where it was issued. Notify the Secretary of State whenever your address changes so the commission record can be updated.

Changing Your Name

Name changes during a commission

  1. Continue using the commissioned name. Continue signing with the surname shown on the commission.
  2. Add a notation to the commissioned name. You may add wording such as “presently” or “now” followed by the new name. Example: Sally Smith, presently Sally Jones.
  3. Change the name on the commission. Purchase a new seal, place its imprint on the Notary Change Form, and submit it. The Secretary of State will issue a name-change certificate without an additional filing fee.

Wait for confirmation

Do not notarize using a new name or seal until you receive confirmation from the Secretary of State. The new seal must correspond exactly to the signature and name recorded with the office.
