Campaign Finance Complaint Process

Requirements for submitting a signed and sworn affidavit alleging a violation of South Dakota campaign finance law.

Scope

Complaints involving acts on or after July 1, 2017

The current Secretary of State guidance states that only complaints pertaining to acts on or after July 1, 2017 will be considered through this process.

Affidavit Requirements

What the complaint must include

  • Identification of the person or committee that is the subject of the complaint.
  • The campaign finance requirement allegedly violated.
  • Any alleged misconduct, breach of statutory duty, or malfeasance.
  • Every fact on which the affiant relies.
  • Any printed source of factual information.

Signed and sworn

The complaint must be submitted as a signed and sworn affidavit. Knowingly making a false allegation under the applicable statutes is a Class 2 misdemeanor.

Review Process

What happens after filing

Initial review

The Secretary of State reviews whether the sworn affidavit contains sufficiently substantiated facts suggesting probable cause.

Contested case

The Secretary of State may commence a contested-case procedure under SDCL chapter 1-26.

Investigation referral

The complaint may be referred to the Division of Criminal Investigation, with notice to the subject by certified mail.
