Required handling of voter-registration records

Application Date

Operative registration date

Consistent with SDCL 12-4-6.1, when an application is submitted to an agency within five days after a voter-registration deadline, the operative registration date is the date the applicant signed and dated the application, not the mailing, postmark, or county-auditor receipt date.

Receipt and Transmission

Date-stamp and logging procedures

Agencies must date-stamp voter-registration applications when received and maintain uniform written procedures documenting when each application is transmitted to the appropriate county auditor.

Address Changes

Driver-license transactions

Consistent with 52 U.S.C. 20504(d), driver-license office address changes must be transmitted to election officials to update voter-registration records unless the applicant affirmatively opts out.

Covered offices should use the same approved forms, scripts, privacy protections, transmission logs, and escalation procedures across in-person and remote transactions.

Covered transactions

Transactions identified in the NVRA include applications, renewals, and change-of-address requests for driver licenses and non-driver identification cards, as well as applications, renewals, recertifications, and change-of-address requests for public assistance, whether conducted in person or remotely.
