The
Secretary of State is the filing agent for Trademarks, Emblems, and Name
Registrations under the laws of South Dakota. Hopefully the following
information will assist you when filing your trademark, emblem, or
farm/ranch/home name registration.
A trademark protects the name of a business or product, a patent protects an
invention and a copyright protects an original artistic or literary work.
The Secretary of State does not process copyrights, patents or US trademarks.
The telephone numbers for those offices are:
US Patent & Trademark Office: 703-308-HELP or 1-800-786-9199
Copyright Office: 202-707-3000
We have tried to make the trademark application, renewal, and assignment
applications easy to understand so that you can complete them in a short amount
of time. Feel free to contact my staff with any questions or concerns you have
regarding the trademark application process. The Trademark Administrator can be
reached through email at
trademark@state.sd.us
or call him at 605-773-5007.
Sincerely,
Jason Gant
Secretary of State
