Does SOS answer telephone inquiries regarding filings under UCC?
Yes, the office of the Secretary of State will answer telephone inquiries regarding filings under the Uniform Commercial Code (UCC). The Secretary of State reserves the right to limit the information given over the telephone, and is not responsible for accuracy and completeness of the information furnished verbally in response to a telephone request (
SDCL 57A-9-523(d)).
Does SOS accept faxed or emailed search requests?
Yes, the Secretary of State's office will accept a faxed or emailed search and/or copy request if all of the required information is provided.
Download a SD Information Request Form. A $5 fax/email convenience fee applies to any request for information results to be returned by fax.
Does SOS accept faxed UCC filings?
No, the Secretary of State's office cannot accept faxed UCC Financing Statements or amendments. Those filings must be either filed online with our
UCC filing system or mailed to our office with payment. Web prepared forms completed with our online system and mailed with payment reduce the possibility of rejection when they arrive at the SOS office for filing.
What payments are accepted?
Payments accepted are: American Express, Visa, MasterCard, Discover, check, cash or money orders.
As a service to lending institutions the Secretary of State has implemented a Pre-Paid Account Deposit (PAD) program in order to accept a deposit for filing fees. Filing fees, search request fees and copy charges can be deducted directly from the PAD account, Download a PAD Account Registration Form or for more information about setting up a PAD account, contact our office at 605-773-3537.
What signatures are required for EFS documents?
The following are signature requirements for EFS documents filed by PAPER:
- Original EFS documents require both Secured Party and all Debtors' signatures.
- Continuations require Secured Party signatures only.
- Assignments require Secured Party and all Debtors' signatures.
- Terminations require Secured Party signatures only.
- Amendments:
- Secured Party name change requires Secured Party signatures only.
- Debtor changes require Secured Party and all Debtors' signatures.
- UCC collateral only changes require no signatures. (UCC/EFS previously filed jointly documents only)
- EFS collateral changes require Secured Party and all Debtors' signatures.

Buyer Registration
Federal regulation (Packers & Stockyards, Food Security Act of 1985, Section 1324) requires the Secretary of State's Office to maintain a list of South Dakota Registered Buyers. These are buyers of farm products, commission merchants and selling agents who register with the Secretary of State.

When do UCC and EFS Filings lapse?
5 years from filing date. Can be continued 6 months prior to lapse date.
Who do I write the check to when collateral is sold?
We can only answer the question of who is listed on a UCC or EFS document. We cannot answer the question of who a check is to be written to, that is a legal question and should be directed to legal counsel.
